FOUNTAIN GREEN -The Fountain Green City Council has passed a new ordinance for the unlawful use of engine and compression breaks.
On Nov. 18, the council held a public hearing prior to the regular scheduled council meeting, where nobody spoke a word about the proposed ordinance. The council passed the ordinance in a majority vote later that same evening.
The purpose of the ordinance is to prohibit the excessive, loud, unusual, or explosive use of engine retarding and compressed air-breaking devices within designated areas of Fountain Green.
The issue was brought to light at the Oct. 21 city council meeting when resident Lewis Rasmussen asked the council to look at adding a noise ordinance for compression breaks coming through Fountain Green. He said he sat on his front porch one day from 8 a.m. until 6 p.m. and counted 250 trucks going both directions.
Rasmussen said that it’s not just the big semi-trucks that are causing all the noise. He said you can’t tell the difference between a semi and a Dodge pickup anymore.
Mayor Mark Coombs has spoken with UDOT and signs will be placed on both ends of Fountain Green along S.R. 132 stating “vehicle noise laws enforced” or “engine brake ordinance enforced.”
Coombs said that they will be placed far enough outside of town on the north end to give trucks plenty of time to prepare.
Any person, firm or corporation violating the ordinance shall be guilty of a misdemeanor and upon conviction shall pay a fine not exceeding $300 for each offense.
